Work Permit

Canadian Work Permit is provided to the skilled workers who hold a valid job offer from Canada. However, a work permit doesn’t make you the permanent resident of Canada.

Before you apply for a work permit, you need to have the LMIA (Labour Market Impact Assessment) approved employment letter from a Canadian employer. It is necessary to meet the eligibility criteria to apply for work permit in Canada.

There are two different types of work permits:

  • Open Work Permit
  • Employer Specific Work Permit

Open Work Permit:

With an open work permit, a foreign worker is allowed to work for any employer in Canada except those who have failed to comply with the employment standards or businesses. You don’t need a positive Labour Market Impact Assessment (LMIA) in order to apply.

You may be eligible for an open work permit if you are in one of the following situations:

  • Permanent residence applicants who have applied to an office in Canada,
  • Dependent family members of some permanent residence applicants,
  • Spouses and common-law partners of some workers and international students,
  • Refugees, refugee claimants, protected persons and their family members,
  • Some temporary resident permit holders, or
  • Some young workers participating in special programs.

Employer-Specific Work Permit:

An employer-specific work permit allows a foreign worker to work for a specific employer for the specific time period. In this, you would need a positive LMIA to prove that there is no Canadian citizen or permanent resident available for the job.

General Requirements:

  • Obtain an employment offer (LMIA approved) from an approved employer in Canada.
  • Convince the immigration officer that you will leave the country once your work permit expires.
  • Must not have any serious medical condition.
  • Must have sufficient funds to support yourself and your family members (if any).
  • Must not have any criminal record.

Highlights:

  • Allows you to invite your family to stay with you
  • Allows your family to work and study in Canada
  • Allows you to stay and work in Canada
  • After spending sufficient time in Canada, you can opt for permanent residency.
